A DCFS (Department of Children and Family Services) Appeal allows parents to challenge an indicated finding of a child abuse or neglect. Parents have 60 days to file an appeal from the date listed on the indication letter. A DCFS Appeal can either be resolved via a Mitigation Proposal, or via a trial which involves a hearing before an administrative judge. If unsuccessful, a subsequent appeal can be filed in the Illinois Circuit Court.
LEARN MOREThis is when a child is actually taken from the parents and placed in the custody of DCFS. DCFS will notify the parents that they are taking protective custody (PC) of the child(ren). The State's Attorney then has 48 hours to file a Petition for abuse or neglect in juvenile court. The case then goes to hearing on Temporary Custody (TC) or Shelter Care Hearing. If the Judge takes TC then the child is made a temporary ward of the court. The case will then proceed to Adjudication which is a trial where the judge determines if the child has been abused or neglected based on DCFS investigations. The Adjudication often occurs within 90-120 days after TC is taken.
